Former Harris County District Attorney Kim Ogg appeared back in court Tuesday morning in the latest court appearance for an alleged gag order violation.
Former Harris County District Attorney Kim Ogg appeared back in court Tuesday morning in the latest court appearance for an alleged gag order violation.
On Tuesday, Ogg’s appearance was rescheduled, and a new court date was not announced.
In her last appearance back in June, Ogg’s defense argued she should not be held in contempt of court after she was accused of violating a gag order in the Jocelyn Nungaray case.
Ogg is accused of disclosing that one of the suspects, Franklin Peña, allegedly raped an American woman in Costa Rica before Jocelyn’s murder in Houston.
Defense attorneys say Ogg crossed the line by repeatedly speaking to the media after the gag order was issued and say those comments were prejudicial and inaccurate.
On June 18, Judge Hill signed a new gag order in Jocelyn’s murder case, following televised interviews in which Ogg revealed new details about the case.
The gag order was revised after Judge Hill was asked by both the prosecution and defense to hold Ogg in contempt of court following her public comments.
In June, the defense presented additional evidence pointing to media appearances, which they argue violated the initial gag order that was put in place to protect the case.
