Fort Bend County Judge KP George’s legal team files motions for dismissal of DA Brian Middleton, criminal charges

Attorneys representing Fort Bend County Judge KP George have filed a motion seeking to disqualify District Attorney Brian Middleton from prosecuting George’s criminal case.
The motion was filed on Oct. 31. If the prosecution is not disqualified from the case, George’s team is asking for the dismissal of his criminal case.
The criminal cases George is facing stem from two indictments:
- A 2024 indictment accusing him of online impersonation. George is accused of using a fake social media alias to posts racist comments directed at himself and others during his 2022 Fort Bend County judge reelection campaign — an accusation the judge has denied and called politically motivated.
- A 2025 indictment surrounding felony money-laundering charges tied to a 2019 campaign-finance report.
The press conference only mentioned the 2024 indictment in regard to the requests for dismissal.

In June, Taral Patel — a former staffer for George — pleaded guilty to two misdemeanor charges after an investigation found he created fake social media accounts, impersonated officials, and posted racist comments about himself to gain voter sympathy during his 2024 campaign for Fort Bend County Precinct 3 Commissioner against Republican incumbent Andy Meyers.
In court documents released as part of his plea agreement, he admitted to working with George while committing an offense.

A press release from George’s team announcing the new court filings was released on Monday. It accused Middleton’s office of prosecutorial misconduct in the filings, claiming that political retaliation and destruction of evidence have been present in the investigation into George.
Among other infractions, the motion claimed that prosecutors used encrypted and auto-deleting messaging apps, such as Signal and WhatsApp, to discuss the legal proceedings. The filing claims this violated “the State’s legal obligation to disclose potentially exculpatory information to the defense.” It also alleged the DA’s office destroyed three minutes of a recorded interview with a cooperating witness that implicated other public officials.
George’s lawyers also argued that Middleton targeted George because he switched from Democrat to Republican in a shocking announcement in June.
The motion cited messages allegedly written by Middleton, in which he said he was “fuming mad,” used explicit language about George and called him a “rat.”
Here are some of the messages Middleton was accused of sending in George’s press release:
“In one text message, DA Middleton writes, ‘I am furious that he called me with that immature bulls--t. I am not the one to pick a fight with.’”
In another Signal post Middleton writes ‘He spread the rumor about alleged affair... I am fuming mad... I told KP he was a rat. This s--t is bad.”
A hearing date for the new motion has not yet been set at this time.
