Sex charges against Liberty County Pct. 3 Commissioner David Whitmire dismissed

A criminal case involving Liberty County Pct. 3 Commissioner David Shirell Whitmire, who is accused of using his public office to solicit sex and exploit a woman desperate for help with a child custody case, is now in the hands of the Montgomery County District Attorney’s Office, according to court documents.

Three criminal charges involving Liberty County Pct. 3 Commissioner David Shirell Whitmire, who was accused of using his public office to solicit sex and exploit a woman desperate for help with a child custody case, has now been dismissed, according to the Montgomery County District Attorney’s Office.

Whitmire, who drew attention earlier this year for mocking animal advocates, was indicted by a Liberty County grand jury in April on three counts: sexual assault, official oppression, and solicitation of prostitution, according to court documents obtained by KPRC 2.

The charges were dismissed at the request of the victim, according to the district attorney’s office.

Only one charge still stands, which was the abuse of official capacity charge. According to records, he was indicted on that charge on Sept. 18.

The indictment states Whitmire is accused of using county equipment, tools, and workers for personal benefit. Specifically, between September 2023 and August 2025, he allegedly had county machinery and employees work on his own home or his family’s home. This use of government property and services was without proper authorization and was worth between $750 and $2,500.
